Quashment of FIR on the illegality of Police
PLJ 2012 · Lahore High Court (Rawalpindi Bench)
This case involved a petition filed before the Lahore High Court, Rawalpindi Bench, seeking to quash an FIR registered against Muhammad Munir under Section 216 of the Pakistan Penal Code, which deals with harbouring an offender. The FIR alleged that Munir helped his two sons, who were wanted in a separate case, escape from police custody when officers tried to arrest them.
The petitioner argued that there was no real evidence proving his sons were ever legally declared proclaimed offenders, and that no proof existed connecting him to the alleged act of harbouring them. The police had relied only on the original complaint and a site plan, without properly verifying the sons' status as proclaimed offenders or establishing any concrete evidence against the petitioner.
The court examined the legal definitions of harbouring under Section 52-A and the offence under Section 216 of the PPC, and found that the essential elements of the offence were missing. Since there was no credible evidence linking Munir to the crime, the court held that forcing him to stand trial would be a futile and unjust exercise, likely to end in acquittal anyway. It emphasized that while offenders must be punished, individuals also have a constitutional right to protection against false or baseless charges, and courts should resolve such matters early rather than let innocent people suffer the ordeal of a trial.
The court ruled that the police had committed a clear illegality in registering the FIR, making the entire proceeding void
