Possession can be restored to Tenant
PLJ 2012 · Islamabad High Court
This case involved a landlord-tenant dispute in Islamabad. The landlord sought to evict her tenant from a house, claiming she needed it for personal use—specifically, to accommodate her mother-in-law, a cancer patient who required frequent treatment in Rawalpindi/Islamabad, making travel back and forth from Wah Cantt inconvenient. The tenant argued, among other things, that a similar eviction petition had previously been filed and withdrawn, so the second petition should not be allowed without special permission, and that although the lease had expired, it had been orally extended.
The Rent Controller initially dismissed the landlord's eviction request, but an appellate court reversed this and ordered the tenant to vacate within 60 days. The tenant then challenged that decision before the Islamabad High Court.
The High Court upheld the eviction. It ruled that since the earlier petition was withdrawn without any final decision on its merits, filing a fresh petition was legally permissible. The court also clarified that under the Islamabad Rent Restriction Ordinance, a landlord's genuine statement of personal need is generally sufficient to justify eviction, especially since the law protects tenants by allowing them to reclaim possession if the landlord doesn't actually occupy the property within six months. Additionally, since the lease had expired and wasn't formally renewed, the tenant was liable to vacate. The petition was dismissed, reinforcing landlords' rights to reclaim property for genuine family needs.
