Police is not statutory prohibited for reinvestigating a case
PLJ 2012 · Balochistan High Court
This case involves an appeal against a conviction under the Control of Narcotic Substances Act, 1997. Abdul Jabbar was caught driving a vehicle containing 170 kilograms of charas hidden in secret compartments, and a trial court sentenced him to life imprisonment and a fine. He appealed to the Balochistan High Court.
The key issue was how the evidence was handled. Initially, only small samples from 10 of the 140 recovered packets were sent for chemical testing. Later, after the prosecution's witnesses had already testified at trial, the investigating officer sent additional samples from all the remaining packets for testing without getting the trial court's permission first. The appellant's lawyer argued this was procedurally improper, and the state's own counsel admitted the investigator had no authority to send samples for testing after the case had already gone before the court.
The High Court agreed that this was a problem. It held that when the law requires something to be done in a specific way, that procedure must be followed exactly, and no shortcuts are allowed. Because the second chemical report was obtained improperly, the court ruled it inadmissible as evidence. However, the court also clarified an important principle: police are not legally barred from reinvestigating a case multiple times or filing a fresh charge-sheet based on new investigation. Despite finding the second report inadmissible, the court ultimately dismissed the appeal, upholding the conviction based on other valid evidence.
