Civil Revision of a case for declaration

PLJ 2012 Peshawar 7 · Peshawar High Court

This case involved a family dispute over inherited land in Peshawar. Two petitioners, claiming to be the son and widow of a deceased landowner named Ghulam Muhammad, filed a lawsuit asking the court to declare an inheritance mutation (an official land record transfer) invalid. That mutation, recorded in 1986, had transferred the deceased's property to other relatives without including the petitioners as legal heirs. The petitioners argued they had been left out due to fraud, that the son was a minor at the time, and that the widow was an illiterate, secluded woman (parda nasheen) who couldn't have knowingly given up her rights. The widow also separately claimed a portion of land as her dower (a marriage-related entitlement) based on a dower deed allegedly executed by her husband years earlier.

Both the trial court and the first appellate court rejected these claims, finding the evidence unconvincing. The dower deed lacked key legal formalities, was never officially registered, and its witnesses were never produced in court. Testimony about the petitioners' marriage and inheritance claims was inconsistent and based on hearsay rather than direct knowledge.

The Peshawar High Court, reviewing the case, agreed with the lower courts. It found no legal errors or misreading of evidence in their decisions and dismissed the petitioners' revision petition, upholding the original mutation. The case illustrates how courts require solid, direct evidence—not assumptions or secondhand claims—especially when disputing official property records long after the fact.
