New Plea in Constitutional Petition is not permitted
PLJ 2012 Peshawar 13 (DB) · Peshawar High Court
This case involved a husband and wife whose marriage was performed in 1990. The wife filed a family court suit seeking recovery of her dower (29 tola of gold ornaments), maintenance allowance, recovery of dowry articles, and dissolution of marriage, claiming her husband had divorced her in April 2003 and turned her out of the house. The husband denied pronouncing divorce. The trial court ruled in the wife's favor, granting the dower, maintenance, dowry articles, and dissolution of marriage, relying on the wife's own statement that she had been divorced. The appellate court upheld most of this but modified the list of dowry articles she was entitled to recover.
The husband then challenged this in the Peshawar High Court, arguing for the first time that the wife's claim for dower was filed beyond the three-year limitation period, and also asking that the dissolution be treated as Khula (so he wouldn't have to pay dower) rather than divorce.
The High Court rejected these arguments. It held that a party cannot raise a brand-new legal plea, like limitation, for the first time in a constitutional petition if it was never raised in the pleadings, never made an issue at trial, and never argued in the lower courts or the appeal. The court also noted that even in Khula cases, the law does not require a wife to return the entire dower received. This case matters because it reinforces the principle that courts will only consider issues that were properly raised and contested at earlier stages, preventing parties from introducing surprise arguments later.
