Personal Need of Landlord in Islamabad Rent Law Case

PLJ 2012 · Islamabad High Court

This case from the Islamabad High Court involved a dispute between a tenant, Nadeem Asghar, and his landlords over rented commercial premises in F-7 Markaz, Islamabad. The landlords had filed an ejectment petition seeking to evict the tenant on several grounds, including non-payment of rent, personal need, subletting, property damage, and expiry of the lease. The Rent Controller initially ordered eviction based on default in rent payment and the landlord's personal need. On appeal, the Additional District Judge overturned the default finding but upheld the eviction on the ground of personal need, since the landlord, a doctor, wanted the premises to build a hospital for himself and his daughter, also a doctor. The tenant then challenged both decisions through this writ petition, arguing the landlords had not clearly specified how the space he occupied was needed, especially since another portion of the building was already vacant.

The High Court upheld the eviction, ruling that it is a landlord's legal right to reclaim property for genuine personal need, and courts should not interfere with that prerogative when the need is shown to be bona fide. However, the court clarified an important safeguard: if the tenant is evicted but the landlord does not actually use the premises for the stated purpose, the tenant can apply to the Rent Controller under Section 17(6) of the Islamabad Rent Restriction Ordinance to be reinstated. This decision reinforces landlords' rights while protecting tenants from misuse of eviction orders.
