Can trial court recall its own order
PLJ 2012 Lahore 89 · Lahore High Court (Rawalpindi Bench)
This case involved a property dispute where a buyer sued a seller for specific performance of a sale agreement after the seller allegedly failed to complete the sale. During proceedings, the seller's representative made a statement conceding the case, but the seller later changed his position, disputed the authority of his attorney, and sought to be added as a party to contest the matter on merits. The trial court initially accepted the seller's applications, which the buyer challenged. Later, the trial court actually signed and announced a judgment decreeing the suit in the buyer's favor based on a compromise statement, but then, on the very same day, recalled its own judgment.
The Lahore High Court held that once a judge signs and pronounces a judgment, the court becomes functus officio, meaning it loses the authority to alter or recall that judgment on its own. The proper procedure would have been to file an appeal or a formal review, not for the trial court to simply reverse itself on a verbal request. The court also found that the seller's conduct did not amount to an unconditional admission, so Order XII Rule 6 of the Civil Procedure Code, which allows courts to decree cases based on clear admissions, did not strictly apply. The High Court ruled that the matter required proper evidence and formal issues to be framed, and sent the case back to the trial court for a fresh decision on merits. This case clarifies that courts cannot casually undo their own final orders after pronouncing them.
