Limitation in case of Shufa

PLJ 2012 Lahore 411 · Lahore High Court (Rawalpindi Bench)

This case concerned a dispute over the right of pre-emption, a legal right that allows certain persons, such as co-sharers or neighbors, to buy property before it is sold to someone else, or to claim it after sale by filing a lawsuit within a strict time limit.

The petitioner, claiming superior pre-emption rights as a co-sharer and neighbor, filed a suit for possession of land that had been sold to Respondent No. 3 through a registered sale-deed dated 28.12.2005. He argued he only learned of the sale on 19.07.2006 because the vendee kept it secret, and since the Revenue Officer never issued the notice required under Section 31 of the Punjab Pre-emption Act, 1991, the four-month limitation period should run from his date of knowledge rather than the registration date. His suit, filed 31.07.2006, would then be within time.

The trial court initially agreed, but the Additional District Judge reversed this on revision, rejecting the plaint as time-barred. The Lahore High Court upheld that decision. It ruled that under Section 30 of the Act, the limitation period starts from the date of registration of the sale-deed itself, which is treated as public notice. Section 31's notice requirement is a separate, independent provision and failure to issue it does not extend the limitation period. Since the suit was filed more than four months after registration, it was rightly dismissed as time-barred.
