Civil Revision not competent when Right of Appeal lies

PLJ 2012 Lahore 335 · Lahore High Court

This case from the Lahore High Court involved a long-running land pre-emption dispute, originally filed in 1975, where the plaintiffs claimed a superior right to buy land that had been sold to others. The case had already been through one remand after an earlier appeal, and the trial court eventually decreed in favor of the plaintiffs partly based on a disputed "compromise statement" allegedly made by one defendant, which another defendant had refused to thumb-mark, making it legally doubtful. The first appellate court partly overturned this, ruling against two of the defendants but upholding the decree against the one who had made the disputed statement.

The High Court found that the plaintiffs had failed to prove their superior right of pre-emption at the three legally required stages (time of sale, filing of suit, and decree), since neither the plaintiffs nor their witnesses gave proper affirmative evidence. It also ruled that the lower courts were wrong to rely on the disputed compromise statement, since it was never properly proved and was contested during the proceedings.

Importantly, the court held that since the petitioners had a statutory right of second appeal available to them (based on the value of the suit at the time of filing), they could not instead file a civil revision. A civil revision is only permitted when no right of appeal exists. Because of this, the civil revision was dismissed as not competent, reinforcing a key procedural principle in civil litigation.
