Suit for recovery of dowry articles
PLJ 2012 Lahore 332 · Lahore High Court
This case involved a husband, Muhammad Imran, who challenged where his wife's lawsuit for recovery of dowry articles was being heard. After a family court in Bahawalpur had already decided the couple's divorce case and rejected the wife's maintenance claim, a separate suit by the wife to recover her dowry items remained pending in the same court. The husband argued that the Bahawalpur court had no territorial jurisdiction to hear this dowry suit, claiming his wife actually belonged to Khanewal district, where the marriage had also taken place. The family court rejected his objection, and he then approached the Lahore High Court to overturn that decision.
The High Court dismissed his petition. It explained that under a 2002 amendment to the Family Courts law, along with the Family Courts Rules, a wife is entitled to file a suit for recovery of dowry articles in the family court located wherever she ordinarily resides, regardless of where the marriage occurred or where dissolution and dower cases are filed. The court also noted the husband had not objected to the same court's jurisdiction when it handled the earlier divorce and maintenance cases, making his sudden objection in the dowry case inconsistent.
This ruling matters because it clarifies that family courts must prioritize convenience for wives seeking recovery of dowry items, allowing them to sue in their own place of residence rather than forcing them to travel to where the marriage was performed.
