Possession can not be restored through illegal dispossession act
PLJ 2012 Lahore 326 · Lahore High Court
This case from the Lahore High Court dealt with a dispute over agricultural land in Okara. The land owner had filed a complaint under the Illegal Dispossession Act, 2005, alleging that the people farming his land under a lease agreement refused to vacate and had illegally taken possession after their lease period ended. While that complaint was pending, the parties reached a compromise before the Additional Sessions Judge, extending the lease until 30 June 2011 with payment through post-dated cheques, and the complaint was formally disposed of.
Later, after the lease period ended, one of the cheques was dishonoured. The land owner then filed a fresh application before the same judge, who ordered the original occupants to hand back possession, backed by police assistance. The occupants challenged this order in the High Court.
The High Court ruled that once the original complaint was disposed of through compromise, the judge became "functus officio," meaning he no longer had any jurisdiction over the matter. Since no case under the Illegal Dispossession Act was still pending, the judge had no legal power to pass a fresh order restoring possession based on an alleged breach of the compromise. The Act contains no provision allowing such restoration after a case is already closed. The court therefore declared the order illegal and without jurisdiction, and allowed the petition.
This case clarifies that courts cannot reopen settled disputes to enforce compromise terms unless specific legal authority exists for it.
