Judgment on Revisional Jurisdiction
PLJ 2012 Lahore 308 · Lahore High Court
This case concerns a family land dispute from Pasroor. The petitioners sued claiming ownership rights over property that had been gifted by their relative to his daughters through a mutation in 1987. During the trial, the petitioners were repeatedly given chances—eleven in total—to produce evidence, but on 18.7.2008 their evidence was again absent, so the trial court closed evidence and dismissed the suit under Order XVII, Rule 3 of the Civil Procedure Code.
The petitioners appealed, but filed it late, well beyond the thirty-day limitation period prescribed under the Limitation Act. They asked the appellate court to excuse the delay, citing confusion over the next hearing date caused by court staff, but the appellate court rejected this explanation and dismissed the appeal as time-barred.
The High Court, hearing the petitioners' further challenge, upheld both lower court decisions. It calculated the limitation period precisely, found the appeal was filed months too late, and ruled that the explanation offered did not amount to sufficient cause for condoning the delay. The court also clarified that its special revisional powers could only be used where a lower court had wrongly assumed, refused, or exercised jurisdiction illegally or with serious irregularity—conditions not met here.
The petition was dismissed, meaning the original dismissal of the suit stood. The case highlights how strictly limitation periods for appeals are enforced, and that mere administrative confusion is often insufficient to excuse delay.
