Order 41 Rule 27 CPC related with Additional Evidence
PLJ 2012 Lahore 264 · Lahore High Court
This case involved a long-running land dispute between the legal heirs of two deceased men, Muhammad Tufail and Nazir Hussain, over agricultural land in Nankana Sahib district. Tufail had claimed ownership of land through a 1975 sale deed from a man named Murad, arguing certain revenue entries made in favor of the opposing party were illegal and done without notice to him. Both the trial court and the first appellate court rejected his claim and dismissed his suit.
Tufail then filed a civil revision petition in the Lahore High Court, which was initially dismissed in 2003. He appealed to the Supreme Court, which sent the case back, directing the High Court to specifically rule on his pending application to introduce additional evidence (under Order 41 Rule 27 of the Civil Procedure Code) before deciding the revision again.
On reconsideration, the High Court held that while courts do have power to admit additional evidence at later stages, including during revision, if doing so is essential for justice, the documents Tufail wanted to introduce were not relevant to the actual land dispute, and he had failed to explain why he didn't produce them earlier when he had the opportunity during the appeal. Since the lower courts' factual findings were well-reasoned and based on proper evidence, the court declined to disturb them and dismissed the revision petition.
This case clarifies when courts can allow additional evidence late in litigation and confirms that such evidence must be both relevant and justified by genuine necessity, not just convenience.
