Order 23 Rules 3 CPC

PLJ 2012 Lahore 149 (DB) · Lahore High Court (Multan Bench)

This case involved a dispute between the Income Tax Department (appellant) and four employees who had been promoted on an acting-charge basis to Inspector posts after passing a departmental promotion exam in 2004. The employees complained that, unlike colleagues in other zones who received the salary of the higher post they were officiating on, they were being paid only according to their original lower grade. They filed a writ petition seeking promotion and the corresponding salary.

The single judge of the Lahore High Court disposed of their petition based on a consent order, agreed to by lawyers for both sides, directing that the employees be paid according to the pay scale of the acting post they were working on, and that their promotion case be decided following a relevant Supreme Court precedent.

The department later tried to appeal this consent order. The Division Bench dismissed the appeal, holding that once both parties agree to a settlement in court, they give up their right to challenge it later through appeal, as established under Order 23 Rule 3 and Section 96(3) of the Civil Procedure Code. The court also rejected the argument that the order violated constitutional provisions on service tribunals, noting the real issue was discriminatory salary treatment, not improper promotion by the court.

This judgment reinforces the principle that consent orders are final and binding, discouraging parties from going back on agreements they voluntarily made in court.
