Revision in case of partition suit
PLJ 2012 Lahore 111 · Lahore High Court (Rawalpindi Bench)
This case involved a dispute over jointly owned agricultural land in village Bhaun, District Chakwal. Ghulam Haider, whose legal heirs later became the respondents, claimed that the jointly held land had been formally partitioned between him and the other co-owners (predecessors of the petitioners), that a specific share of over six kanals had been allotted to him, and that he had been in possession until the petitioners illegally dispossessed him. He sued for recovery of possession.
The trial court dismissed his suit, finding no proof of partition or possession. On appeal, the District Judge reversed this and ruled in favor of the respondents. The petitioners then challenged that appellate decision before the Lahore High Court through a civil revision.
The High Court examined the evidence and found it lacking. The respondents could not produce the actual partition order, revenue records showing delivery of possession, or supporting documents proving the claimed division of land. The mutation entries relied upon were not properly signed or countersigned by competent revenue authorities, and one key document even contradicted the respondents' own claims about ownership shares.
The court ruled that mere unverified entries in revenue registers carry no legal weight without proper authentication. Since the respondents failed to prove partition or transfer of possession, the High Court set aside the appellate court's decision and restored the trial court's original dismissal of the suit. This case underscores that claims of property partition must be backed by properly authenticated official documents, not just informal or unverified revenue entries.
