Suit for Pauperis can be filed without court fee

PLJ 2012 Karachi 41 (DB) · Sindh High Court

This case was about a man who filed a civil suit for damages after being wrongly prosecuted and later acquitted. Unable to afford court fees, he applied to sue as a "pauper" (an exemption allowing poor litigants to file without paying court fees upfront). This application was rejected by the courts, including on revision. He then asked the trial court for more time to pay the required court fee instead, which was granted, and his suit was admitted for hearing.

The opposing party later argued that once his pauper application was rejected, his case no longer had a valid "cause of action" and the suit should be thrown out. The trial court disagreed, but a revisional court sided with the opposing party and rejected the plaint entirely.

The Sindh High Court overturned this, ruling that the rejection of a pauper application and the existence of a cause of action are two completely separate legal issues. Being refused fee exemption does not erase someone's underlying right to sue; it simply means they must pay the court fee like any other litigant. Since the petitioner was given time to pay the fee and did so, his suit was properly before the court. The High Court held the revisional court had misunderstood the law and sent the case back for proper proceedings.

The ruling matters because it protects poor litigants' access to justice, clarifying that fee disputes should not be used to wrongly kill genuine legal claims.
