Maintainability of Civil Revision against High Court Decision
PLJ 2012 Islamabad 90 (DB) · Islamabad High Court
This case involved a company, Techcorp Holding, that filed a lawsuit against another company, Konnect Holden, seeking recovery of over 22 crore rupees. Instead of responding to the lawsuit normally, Techcorp asked the court to reject the plaint outright. A single judge of the Islamabad High Court rejected this application. Techcorp then challenged that decision by filing a civil revision petition before a two-judge bench of the same High Court.
The key issue the court had to resolve was not the merits of the recovery suit, but a technical question: was a civil revision even the right legal tool to challenge this order? The respondent argued it was not, because the order was merely interlocutory (not a final decision) and such orders are appealable, not subject to revision.
The court agreed with the respondent. It explained that under Section 115 of the Civil Procedure Code, revision petitions can only be filed against decisions of courts subordinate to the High Court. A single judge of the High Court is not considered such a subordinate court. Instead, under Section 15 of the Civil Procedure (Amendment) Ordinance, 1980, interlocutory orders passed by a single High Court judge can be appealed to a two-judge bench through an Intra Court Appeal (ICA), not challenged via revision.
Since Techcorp used the wrong legal remedy, the court dismissed the revision petition as legally incompetent, without deciding the actual dispute over money. This ruling clarifies the correct procedure for challenging single-judge High Court orders in Pakistan.
