If the abductee doesn't resist then offense is not attracted
PLJ 2012 · Lahore High Court
This case involved a man, Muhammad Yar alias Allah Yar, accused of forcibly abducting a woman named Mst. Shazia Nasim for illicit purposes, along with stealing cash and gold ornaments, under charges including abduction and rape (Sections 380, 365-B, and 376 of the Pakistan Penal Code). He sought bail while awaiting trial.
The Lahore High Court granted him post-arrest bail. The court reasoned that the complainant was not an eyewitness, and no one from the area came forward to confirm that the woman had resisted or that force was used during the alleged abduction. Since there was no evidence of restraint or resistance, the court held that the offence of abduction was not clearly established at this stage—suggesting the case looked more like elopement, especially since the woman had appeared before various courts admitting she had married the petitioner (Nikah). The court also noted a suspicious one-month delay in filing the police report, and that the Nikah reportedly took place before the FIR was lodged. A related case questioning the validity of the marriage was still pending, and a co-accused had already been granted bail and cleared during investigation.
This judgment matters because it reinforces a legal principle: for abduction charges to apply, there must be evidence of force or resistance by the alleged victim. Mere allegations, without supporting proof of coercion, may not meet the threshold required to deny bail, especially when conflicting narratives and procedural delays raise doubts about the prosecution's case.
