How to deal with a case of unseen occurrence?
PLJ 2012 FSC 94 · Federal Shariat Court
This case involved two men, Tahir Mehmood and Sajid Ali alias Sajjad Ali Munna, convicted by a trial court in Jhang for murdering two women, Mst. Ferhat Bibi and her maid Mst. Hajran Bibi, and for robbery. Both were sentenced to life imprisonment for murder and additional rigorous imprisonment for robbery. They appealed to the Federal Shariat Court challenging their convictions.
The killings were not witnessed by anyone, meaning there was no eyewitness to the actual murders. The court explained that in such unseen occurrences, judges must apply deeper scrutiny to the available evidence rather than relying on ordinary methods of analysis. It held that testimony from relatives of the victims, such as a brother or husband, is still legally valid evidence even though they have a personal interest in the case, since in murder cases outsiders rarely come forward as witnesses. The court also addressed a technical objection about how the complainant's statement was recorded by police, ruling that the complainant should not suffer because of procedural lapses by the police, and that such statements can still be used for specific purposes under the law.
After reviewing recoveries of weapons, blood-stained clothes, cash, and jewellery, along with supporting witnesses, the court found the prosecution had proven its case beyond doubt and found no legal flaw in the original judgment. The appeals were dismissed, and the convictions and sentences were upheld. This case is significant for clarifying how courts should evaluate evidence when a crime
