Evidence in a Rent Case

PLJ 2012 · Islamabad High Court

This case involved a dispute between a tenant, M/s. King Clothing, and the landlords of a shop in Islamabad's Blue Area. The lease had expired in 2005, and the landlords filed an eviction case before the Rent Controller. The tenant was ordered to deposit monthly rent during the proceedings. The Rent Controller ultimately allowed the eviction, finding that the landlords had proven their case, including their genuine personal need for the property. The tenant appealed, but the Additional District Judge upheld this decision. The tenant then approached the Islamabad High Court through a constitutional petition, arguing that the lower courts had wrongly evaluated the evidence.

The High Court dismissed the petition. It noted that the tenant had failed to comply with earlier court orders to deposit rent, repeatedly delaying the case and attempting to cover up this default through procedural maneuvers. The Court emphasized that parties seeking relief under its constitutional jurisdiction must come with clean hands, and that it would not allow litigants to misuse court proceedings to gain unfair advantage. On the merits, the Court found that the landlords had successfully proven the key issues, including their bona fide need for the shop, and that the tenant's evidence had gone largely unchallenged in cross-examination—meaning the unchallenged testimony effectively counted as an admission of facts.

The Court ordered the tenant to pay all outstanding rent by a set deadline, after which one month would be allowed to vacate the premises. This case highlights how courts assess conduct
