Can the mother take her child abroad during Custody Case?

PLJ 2012 · Sindh High Court

This case involved a custody dispute between divorced parents over their young daughter. The father had remarried and sought custody rights, while the mother, a doctor, had retained physical custody of the child since birth. Lower courts had ruled that the mother keep custody, but restricted her from taking the child outside the court's jurisdiction without permission, while granting the father generous visitation rights including alternate weekends, Eid holidays, and vacation time.

The mother then got a job offer in Dubai and petitioned the Sindh High Court to allow her to take her daughter abroad. She offered to return to Pakistan monthly so the father could maintain contact, and offered to provide guarantees ensuring compliance.

The High Court sided with the mother. It reasoned that just as a father cannot be expected to give up his career to retain custody, a mother should not be forced to sacrifice her professional opportunities either. Since the father had not challenged the mother's right to custody itself, and the courts below had already found her a fit custodian, the High Court held she could take the child to Dubai. To protect the father's visitation rights, the court required the mother to furnish a bond of one million rupees with a surety, which would act as a financial deterrent against her denying the father access to the child.

This case is significant because it establishes that working mothers have the right to custody of their children even while pursuing careers abroad, balancing a parent's professional freedom with safeguards protecting the other parent's visitation rights.
