Benefit of Summer Vacations can be taken if appeal filed on 1st September

PLJ 2012 · Lahore High Court

This case from the Lahore High Court dealt with a long-running property dispute in which a family contested a gift of land made through a mutation (land record entry). During the trial, the plaintiffs repeatedly failed to produce their evidence despite being given eleven opportunities. When their evidence still wasn't presented on 18 July 2008, the trial court closed the evidence and dismissed their suit. The plaintiffs then appealed, but filed that appeal late, also asking the court to excuse the delay.

The key issue before the High Court was whether the appeal was filed within the legal time limit, and if not, whether there was sufficient reason to excuse the delay. The law required an appeal to be filed within thirty days of the judgment, which meant the deadline fell during the summer court vacations. The court held that even allowing for the vacation period, the plaintiffs should have filed their appeal on 1 September 2008, the day courts reopened — but they did not file until 31 October 2008, far too late. The court also rejected their excuse of confusion over hearing dates as unconvincing.

Because the appeal was hopelessly delayed with no valid justification, the High Court dismissed the petition, upholding the lower courts' decisions. The case clarifies how limitation periods are calculated when deadlines fall within court vacations, confirming that vacation benefits only extend the deadline to the day courts reopen, not further.
