Writ Petition by Civil Medical Officer

PLJ 2012 AJ&K 1 · Azad Jammu & Kashmir High Court

This case involved a government doctor, a Civil Medical Officer at Sheikh Zaid Hospital in Muzaffarabad, who wanted to pursue specialized training in pulmonology at a medical college in Abbottabad. He had obtained a no-objection certificate from that institution, but the health department rejected his application to be released for this training. He challenged this rejection through a writ petition filed in the Azad Jammu and Kashmir High Court.

The court dismissed the petition on two main grounds. First, the petitioner had failed to include the Director Health Services, the official who actually issued the rejection order, as a party to the case. The court held that a writ cannot be issued when a necessary party has not been included in the proceedings. Second, and more fundamentally, the court ruled that since the petitioner was a civil servant, challenges to orders affecting his terms and conditions of service could not be brought through a constitutional writ petition at all. Such matters fall exclusively within the jurisdiction of the Service Tribunal, not the High Court. The court relied on a Supreme Court of Pakistan precedent establishing that any order affecting an employee's service conditions, whether a general policy or an individual decision, qualifies as a departmental order that must be challenged before the appropriate Service Tribunal.

This case matters because it reinforces an important jurisdictional principle: civil servants seeking to contest decisions about their employment, training, or deputation must use the specialized Service Tribunal system rather than filing writ petitions directly in the High Court.
