Wakalatnama and Special Power of Attorney attested in foreign country
PLJ 2011 · Lahore High Court
This case involved a dispute over an old agreement to sell a house in Multan, which several heirs (the petitioners) were trying to enforce through a lawsuit for specific performance. One of the plaintiffs, Mst. Shehnaz Nizami, lived abroad in America and tried to authorize lawyers to act on her behalf by signing a Wakalatnama (lawyer's authorization) and a special power of attorney, both of which she signed before a Notary Public in Michigan, USA.
The trial court rejected the plaint because no valid power of attorney was filed for her within the given time, and the appellate court upheld this, also ruling that since all plaintiffs had jointly paid the sale price as one transaction, the case could not proceed if even one plaintiff's participation was legally defective.
The Lahore High Court agreed with the lower courts. It held that simply having a document notarized abroad does not make it valid for court purposes unless the notary or another witness actually confirms the identity of the person signing. Since nothing on the documents showed that the Notary Public had verified that the signer was indeed Mst. Shehnaz Nizami, the documents could not be treated as proper authorization under the law.
This judgment is significant because it clarifies that notarization alone, especially from abroad, is not enough to authorize legal representation in Pakistani courts—proper identification of the signer is essential. The revision petition was dismissed.
