To secure the ends of Justice High Court can pass any order

PLJ 2011 · Peshawar High Court

This case from the Peshawar High Court dealt with a long-running dispute over a private criminal complaint. The petitioner, Mir Qasim Khan, had accused the respondents of using a forged special power of attorney to drag him into a fabricated civil lawsuit. The complaint bounced between a Magistrate, a Sessions Judge, and an Additional Sessions Judge multiple times, with disagreements over which criminal sections applied and which court had jurisdiction, particularly regarding forgery under Section 467 PPC, which must be tried by a Sessions Court.

Eventually a Magistrate found the complaint maintainable and ruled that the forgery allegations did fall under Section 467 PPC, sending the case for trial before the appropriate Sessions Court. The respondents challenged this, but the High Court examined its own inherent powers under Section 561-A of the Criminal Procedure Code, explaining that these powers allow it to make any order necessary to prevent abuse of court process or to secure justice, even without a formal application, and even on matters not directly raised by the parties.

The court also clarified that restrictions under Section 195(1)(c) of the Cr.P.C, which require special permission before prosecuting certain offences, do not apply to forgery under Section 467 PPC. Based on this reasoning, the court allowed the quashment petition, effectively permitting the criminal case to proceed. The judgment matters because it reinforces the High Court's broad inherent authority to ensure fair process and correct procedural errors in criminal cases.
