Several criminals in a case should be treated alike
PLJ 2011 Sh.C. (AJ&K) 80 · Azad Jammu & Kashmir High Court
This case concerned a man named Muhammad Ibrar who had been in jail for about eight years awaiting trial over a land dispute that turned violent in 2002, resulting in three deaths and several injuries. Ibrar was accused of attacking one injured person, Ghulam Rasool, as part of a group assault, though he was not accused of killing anyone directly. He had repeatedly sought bail over the years, including before the trial court, the Shariat Court, and the Supreme Court, but was refused each time.
He filed this fresh bail application after more time passed and trial delays continued, arguing that a co-accused, Muhammad Javaid, who faced more serious allegations including directly killing someone, had already been granted bail by the Supreme Court. Ibrar argued that if a more seriously implicated co-accused got bail, he deserved the same treatment, especially given the lengthy delay in his trial and incomplete recording of evidence.
The Azad Jammu and Kashmir High Court accepted the principle that long, unexplained delays in trial can justify bail, and importantly, that when several accused face similar allegations and evidence, they should be treated consistently - so if one is released on bail, others in a similar position should not be denied the same relief.
This judgment matters because it reinforces two important bail principles in Pakistani law: that indefinite pretrial detention without trial completion is unjust, and that courts must apply consistent standards when multiple accused persons share similar circumstances.
