Supreme Court's Judgment on Forged Documents

PLJ 2011 SC 889 · Lahore High Court

This case was about a land dispute involving allegations of fraud. Ghulam Muhammad claimed that someone forged a general power of attorney in his name, and that a person calling himself his attorney, Basharat Ali, used this fake document to sell his land without his knowledge or consent. Based on this, several sale transactions and mutations (official land transfer records) followed over the years. Ghulam Muhammad sued to cancel these transactions and recover possession of his land.

The trial court and first appellate court ruled that the sale was indeed fraudulent, since the defendants could not produce the power of attorney document itself, failed to produce Basharat Ali as a witness, and failed to call any witnesses who had seen the document signed. However, these courts still dismissed the suit on the technical ground that it had been filed too late, beyond the legal time limit for such cases. The High Court disagreed and ruled in favor of the original owner's heirs.

The Supreme Court upheld the High Court's decision and dismissed the appeal. It held that when a document (like the power of attorney) is proven to never have been validly executed in the first place, it is void from the very beginning, not merely questionable. Such void documents and all transactions based on them have no legal existence at all. Therefore, the stricter three-year time limit for cancelling documents does not apply; instead, a longer limitation period applies to void transactions. This matters because it protects people from losing property rights due to forged documents, even if they discover the fraud years later.
