Court can declare a document null and void
PLJ 2011 SC 889 · Lahore High Court
This case concerned a dispute over land in Pakistan where the original owner, Ghulam Muhammad, claimed that a sale deed and related land mutations were the product of fraud. He alleged he never appointed one Basharat Ali as his general attorney, yet Basharat Ali had purportedly sold his land on his behalf starting in 1972. The buyers argued the lawsuit was filed too late, beyond the three-year limitation period that normally applies to suits seeking cancellation of documents.
The trial court and first appellate court dismissed the suit on limitation grounds, even though they found in the owner's favor on the merits, concluding the power of attorney was never proven to be genuine. The High Court reversed this, and the Supreme Court upheld that reversal.
The Supreme Court explained that when a document like a power of attorney is never validly executed, everything built upon it legally does not exist at all, it is void from the start, not merely voidable. Such void transactions are not subject to the short three-year limitation period under Article 91 for cancelling documents. Instead, they fall under Articles 142 or 144, which deal differently with possession and void transactions. Since the defendants never produced the power of attorney or its witnesses, the court treated the entire chain of sales as void. The appeal was dismissed, affirming that the original owner's suit was not time-barred.
