Determination of Benami Transaction
PLJ 2011 SC 834 · Peshawar High Court
This case involved a family property dispute over a house and plot in Abbottabad. Dr. Asif Ali Khan had a plot registered in his name through a 1983 sale deed and later built a bungalow on it. He sued his brothers to evict them, claiming they were trespassers after being allowed to live there as licensees. His mother then joined the case, arguing that the property was actually purchased by her husband (Dr. Asif's father) using his own money, with the title merely placed in her son's name as a "benami" (nominal) arrangement to avoid taxes, while the real ownership remained with the father.
The trial court dismissed the son's suit, but the Peshawar High Court reversed this and declared the son the exclusive owner, ordering the family to vacate. The Supreme Court disagreed with the High Court's ruling. It found that the High Court had misread the evidence, particularly ignoring a witness's admission that payment for the property had come from a bank draft issued from the father's account, not the son's. The Supreme Court emphasized that determining who actually paid for a property, and who possessed it, are key factors in deciding whether a transaction is benami. Since the son's case relied mainly on the registered sale deed without solid supporting evidence, the Supreme Court restored the trial court's dismissal of the suit. This case illustrates how courts examine real financial contribution and possession, not just paperwork, when deciding true ownership in benami property disputes.
