Judgment on Conflict of Interest

PLJ 2011 SC 798 · Islamabad High Court

This case was about the appointment of the Chairman of the National Accountability Bureau (NAB), Pakistan's top anti-corruption body. The petitioners challenged the appointment, arguing it violated the Constitution and the National Accountability Ordinance, 1999.

The Supreme Court found that the law requires the President to appoint the NAB Chairman only after genuine consultation with the Leader of the Opposition in the National Assembly, aimed at building consensus rather than just going through the motions. In this case, no such consultation had taken place before the Chairman was reappointed on 9 February 2011, making the appointment unlawful.

The Court also ruled that the law's requirement of a "non-extendable" four-year term means a person can only ever be appointed once to that office. Even a fresh appointment made before completing an earlier term would not get around this restriction, since allowing that would let an incumbent's term be artificially cut short and renewed, defeating the law's purpose of limiting tenure.

The Court further held that such petitions, filed under Article 184(3) of the Constitution, were a matter of public importance because the NAB Chairman's decisions affect thousands of people through inquiries, arrests and trials. It also noted that the Chief Justice of Pakistan could appropriately play a role in resolving disagreements over such appointments, given the Chief Justice's constitutional role as guardian of citizens' rights.

The ruling reinforced safeguards ensuring transparent, consultative, and legally compliant appointments to powerful public offices.
