Assertaining the Plea of Alibi in a case

PLJ 2011 SC 40 · Lahore High Court

This case is about whether bail should have been granted to a murder accused, and what weight courts should give to a police investigation finding someone innocent and to the defense of alibi.

The accused, Shoukar Ilahi, was named in an FIR for shooting a man dead during a dispute over sand-lifting from land. He initially got pre-arrest bail but absconded when proceedings continued, and his bail was later dismissed. After a co-accused was granted bail by the High Court on the ground that police investigation had cleared him, the petitioner also surrendered, claimed police had similarly declared him innocent based on an alibi defense (supported by around 60 affidavits), and got bail from the trial court by following that precedent. The complainant challenged this, and the High Court cancelled the bail. The accused then approached the Supreme Court.

The Supreme Court refused to grant leave to appeal, upholding cancellation of bail. It held that a police finding of innocence during investigation is not binding on courts and cannot by itself justify bail. It also found the alibi defense suspicious since it was never raised when the accused first sought pre-arrest bail, and ruled that such a defense, resting on numerous witnesses, needs proper trial testing through cross-examination rather than being decided at the bail stage.

This case clarifies that bail decisions must be based on independent judicial assessment of evidence, not merely on police opinions, and that alibi claims require full trial scrutiny.
