Personal Appearance through special power of attorney
PLJ 2011 SC 262 · Lahore High Court (Rawalpindi Bench)
This Supreme Court case arose from a family dispute in which a woman had filed a suit seeking maintenance for her daughter and recovery of dowry articles worth over Rs. 3,17,000 from her husband. The husband did not appear in person before the Family Court but instead filed his written statement through his brother, acting as his special attorney. The Additional District Judge ruled against the husband, holding that since he had not personally filed the written statement, his defense could not be considered and the suit should be treated as uncontested. The Lahore High Court upheld this view.
The Supreme Court disagreed with this strict approach. It noted that there is no absolute legal requirement that a party must personally appear or file documents in court; an attorney can validly act on behalf of a principal in civil proceedings unless the law specifically requires otherwise. The Court pointed out this was also inconsistent with an earlier High Court ruling on the same issue.
While disposing of the appeal, the Supreme Court directed that the lower courts' reasoning - that a case must fail simply because the written statement was filed by an attorney rather than the party personally - should not be treated as a precedent in future cases. The parties also reached a settlement, with the husband's brother agreeing to pay the dowry amount in installments. This ruling clarifies that litigants are not automatically penalized for using authorized representatives in court filings.
