Judgment against undue delay in criminal trials

PLJ 2011 SC 210 · Peshawar High Court

This case involves Shah Hussain, who along with two co-accused was tried for murder, causing injuries, and robbery (Haraabah) of a jeep. The trial court convicted him and sentenced him to imprisonment for various offences, with sentences to run consecutively, totaling as much as 60 years. On appeal, the Peshawar High Court acquitted one co-accused but upheld Hussain's conviction and sentence. He then petitioned the Supreme Court of Pakistan.

The Supreme Court's judgment focuses heavily on Section 382-B of the Criminal Procedure Code, which requires courts to give convicts credit for time already spent in jail as an undertrial prisoner before sentencing. The Court held that this provision is mandatory, not optional, meaning judges must consider and usually deduct pre-trial detention time from a convict's sentence, and must explain their reasoning if they choose not to. The Court explained this rule exists because undue delays in trials, whether caused by court backlogs or procedural issues, should not unfairly prolong a person's total time in custody. It also ruled that stacking multiple sentences consecutively cannot exceed 14 years under Section 35 of the Cr.P.C., making the 60-year aggregate sentence unlawful.

This judgment matters because it strengthens protections for prisoners' constitutional right to liberty, ensures fairness for those who spend long periods in jail awaiting trial, and limits how harshly consecutive sentences can be stacked, reinforcing that justice delayed should
