Re-Investigation could not be debarred after submission of Challan

PLJ 2011 · Lahore High Court (Rawalpindi Bench)

This case concerns a dispute over the police investigation of a murder arising from a shooting incident at a hotel in Murree, which also involved anti-terrorism charges. After the initial police investigation, one accused was arrested and sent for trial while two others were cleared. Dissatisfied with this outcome, the complainant sought a change of investigation, and a new team found the two previously cleared men guilty. Those two accused then challenged this finding, leading to a Provincial Standing Board recommending yet another re-investigation, which the Inspector General of Police approved. The original complainant then challenged this second change of investigation in the Lahore High Court, arguing that once a challan (police report) had already been submitted to the trial court, the investigation could not legally be reopened, and alleging that the repeated changes favored the influential accused party.

The court dismissed the petition. It held that under Article 18(6) of the Police Order, 2002, a duly constituted board has the legal power to recommend re-investigation, and this power is not barred merely because a challan has already been filed. The court emphasized that an investigating officer's job is only to gather evidence, not to decide guilt or innocence, leaving that determination to the magistrate or trial court. It also noted the complainant could pursue a private complaint as an alternative remedy.

This ruling matters because it clarifies that police investigations can be reopened even after formal charges are filed, provided proper institutional procedures are followed, balancing thorough fact-finding against concerns about delay or misuse.
