This case involved Zia Mohyuddin, who received a scholarship from the Higher Education Commission (HEC) to study for a Master's degree in South Korea. Under his agreement with HEC, he was required to work in Pakistan for two years after completing his studies, or repay the money spent on his education. After finishing his Master's, he could not find a job through HEC, so he accepted a PhD scholarship from a South Korean university. When he tried to fly back to Korea, he was stopped at the airport, arrested, and jailed by the Federal Investigation Agency (FIA) because HEC had placed his name on a watch list, effectively barring him from leaving the country.
The Lahore High Court ruled this action unlawful. It found that neither HEC nor FIA had any legal authority to place him on the watch list or Exit Control List, since the official rules only allow such listing for serious matters like smuggling, terrorism, or human trafficking - not for contract disputes with HEC. The court also held that a person cannot be put on such a list without first being given notice and a chance to be heard, and that any order restricting someone's travel must be properly communicated, not kept secret. Even if the petitioner had breached his agreement, HEC's only remedy was to sue him for money, not to have him detained or stopped from traveling. The court ordered his name removed from the list and allowed him to travel freely.
