Revision over revision is not possible
PLJ 2011 Peshawar 83 · Peshawar High Court
This case involved a long-running property dispute over four marlas of land. During the trial, the petitioners asked the court to appoint a local commission to inspect improvements they claimed to have made on the disputed property. The trial court rejected this request, viewing it as a delaying tactic, and offered to consider it later if a final decree for dispossession was passed. The petitioners appealed to the Additional District Judge, who upheld the trial court's decision. They then filed this revision petition before the Peshawar High Court.
The High Court examined whether it had jurisdiction to hear the case. It ruled that an order rejecting the appointment of a local commission under Order 26, Rule 9 of the Civil Procedure Code is not something that can normally be appealed. Therefore, when the Additional District Judge heard the petitioners' appeal, he was actually exercising revisional powers under Section 115 of the CPC, not appellate powers. Since a district court had already exercised revisional jurisdiction, the law clearly barred the High Court from entertaining a further revision against that order, as Section 115(4) prohibits a "revision over a revision."
The court therefore dismissed the petition for lack of jurisdiction. This decision matters because it clarifies procedural limits: parties cannot keep escalating certain interlocutory orders through multiple rounds of revision, which helps prevent litigation from being needlessly prolonged, something the court itself noted had already happened for five years in this dispute.
