Suit for Correction of Parentage in Revenue Record
PLJ 2011 Peshawar 257 · Peshawar High Court
This case was about a dispute over a man's parentage recorded in government revenue records. The respondent, Abdul Hameed, filed a suit asking the court to correct his father's name in official land records, claiming his father was actually Mehr Khan, though records showed the name as Qutab Khan. The defendant, Abdul Latif, contested this, denying the respondent was Mehr Khan's son at all, effectively disputing his legitimacy and inheritance claims.
The trial court dismissed the suit, but on appeal, the District Judge sent the case back for retrial, directing that the plaintiff be allowed to amend his plaint, bring in all of Mehr Khan's legal heirs as parties, and properly raise the issue of legitimacy so the real dispute could be fully examined with evidence.
The defendant challenged this remand order before the Peshawar High Court, arguing it was improper under the civil procedure rules governing remands. The High Court disagreed and upheld the remand. It ruled that appellate courts have broad powers under the Civil Procedure Code - not just to remand cases on narrow technical grounds, but also to use their inherent powers and general authority (similar to a trial court's own powers) to ensure cases are properly pleaded and all necessary parties and issues are before the court, so that real disputes like legitimacy and parentage are fully and fairly decided rather than dismissed on technicalities. The petition was dismissed.
This matters because it confirms that appellate courts can intervene flexibly to ensure substantive justice, especially in sensit
