Orally gifted property in Nikahnama doesn't require registration
PLJ 2011 Lahore 721 · Lahore High Court
This case involved a dispute over whether property pledged as surety in a court case could actually be seized to pay off a debt, given that it had earlier been given away as a gift through a marriage contract.
A man named Muhammad Hafeez stood as surety for someone else's debt, offering a house as security. When the debt wasn't repaid, the court ordered the property attached and sold to satisfy the decree. However, Hafeez's wife objected, arguing the house was not his to pledge because he had already given it to her at the time of their marriage, as recorded in their Nikahnama (marriage contract), in lieu of her dower rights. The trial court rejected her objection and allowed the attachment to proceed.
On appeal, the Lahore High Court sided with the wife. It held that an entry in a Nikahnama recording the transfer of property to the wife is sufficient legal proof of that transfer, and no separate registration or additional documentation is needed to make the gift valid. Since the husband had already given up his ownership rights over the property before offering it as surety, he had no legal right to pledge it, and the property could not be attached for the debt.
This ruling matters because it confirms that property gifted to a wife through a Nikahnama is legally hers, protecting such transfers from being treated as still belonging to the husband, including shielding them from his creditors or legal obligations.
