Shia widow cannot inherit husband's property
PLJ 2011 Lahore 585 · Lahore High Court (Multan Bench)
This case is about a property dispute between two families claiming to be heirs of Ahmad Ali, a man who died in the 1940s without children. His land passed to his widow, Mst. Hajran Bibi, as a limited owner under customary law. After customary law was abolished, officials transferred the land back to Ahmad Ali's side of the family rather than to the widow's heirs, on the basis that Ahmad Ali was Shia by faith. Under Shia inheritance law, a childless widow does not inherit her husband's immovable property (land), though she may get a share of movable property and household goods. The widow's relatives argued that Muslims in undivided India should be presumed Sunni Hanfi by default and that the claim was filed too late. The trial court initially dismissed the suit, but the appellate court reversed that decision and ruled in favor of Ahmad Ali's relatives. The High Court, in this revision petition, upheld the appellate court's ruling, confirming that since Ahmad Ali was Shia and died without children, his widow had no right to inherit his land, and the land rightly reverted to his blood relatives after her death. This case matters because it shows how a person's religious sect can significantly affect inheritance rights for surviving spouses under Pakistani law, particularly regarding childless widows.
