PLJ 2011 [Lahore] 32) (DB) · Lahore High Court
Rashid Ameer, a constable in Islamabad Police since 2007, wanted to apply for the post of Assistant Sub-Inspector (ASI) in the Counter Terrorism Force. The advertised age limit was 25 years, and he was over-aged by about four years. He asked the Inspector General of Police for age relaxation, citing rules allowing relaxation for government employees with continuous service and for children of civil servants who died during service (his father, a DSP in Sindh Police, had died while in service). The IG Police rejected his request, saying the Establishment Division's relaxation rules did not apply to Islamabad Police, and that allowing relaxation would disrupt the recruitment process which was already underway.
The Lahore High Court disagreed. It examined the Establishment Division's 1993 Rules on relaxation of upper age limits and a later 2010 office memorandum clarifying that government employees with two years of continuous service get a 10-year age relaxation, while general relaxation of 5 years applies to all citizens. The court found these rules did apply to Islamabad Police and that the petitioner, who was 29 at the time and had about 10 years of service, qualified for relaxation. It held that he could not be denied this right which had already accrued to him. The court allowed the petition, meaning his application for age relaxation should be accepted.

لاہور ہائی کورٹ نے اس سے اختلاف کیا۔ عدالت نے اس
