Judgment on Article 4 of Constitution
PLJ 2011 · Lahore High Court
This case involved landowners (encroachers) in Faisalabad who had been occupying land since 1947 and built construction on it in 1995. When revenue authorities earlier tried to demolish their construction, the petitioners went to court, and in 1997 the Lahore High Court directed the Collector to decide their claim in accordance with law. That order was never complied with. Instead, in 2009, the Deputy District Officer (Revenue) issued an order under the Colonization of Government Land Act, 1912, directing officials to forcibly retake the land and seize crops, trees, or building material without compensation and without giving the petitioners any notice or hearing.
The petitioners challenged this order, and the Lahore High Court ruled in their favor. The court held that even people who are encroachers or trespassers still have a constitutional right under Article 4 of the Constitution to be treated in accordance with law. Article 4 was described as Pakistan's "due process clause," guaranteeing fairness, natural justice, transparency, and the right to be heard before any action harmful to a person's property is taken. Since the 2009 order was passed without notice, without a hearing, and without complying with the earlier court directive, it violated Article 4 and could not stand.
The judgment matters because it reaffirms that government authorities cannot take action against anyone's life, liberty, or property—even against illegal occupants—without following fair legal procedure, reinforcing due process as a core constitutional protection for everyone in Pakistan.
