Issueless widow cannot inherit movable property in Shia Law

PLJ 2011 · Lahore High Court (Multan Bench)

This case was decided by the Lahore High Court, Multan Bench, concerning a property dispute that hinged on which Islamic school of law applied to the inheritance of a deceased man's estate. Ahmad Ali died about six months after marrying Mst. Hajran Bibi, leaving no children. His land was recorded in his widow's name as a limited owner. After she later remarried and eventually died, her relatives claimed her inherited share passed to them. However, Ahmad Ali's own relatives (the respondents) argued that he was a Shia Muslim and that, under Shia law, a childless widow cannot inherit any share in her husband's immovable property, only a share in movable property and household items. They sought to have the mutations (land record entries) favoring the widow and her heirs declared void, so the land would revert to Ahmad Ali's rightful heirs.

The trial court initially dismissed the suit, but the appellate court reversed that decision and ruled in favor of Ahmad Ali's relatives. The High Court, after reviewing Shia legal scholarship on inheritance, upheld the appellate court's decision, confirming that since Ahmad Ali was Shia and died without children, his widow had no legal right to inherit his land. The revision petition was dismissed.

This case matters because it clarifies how religious personal law—specifically Shia inheritance rules—can override customary land practices in determining property rights after death, especially regarding childless widows.
