Hidayatullah V. Federation of Pakistan

PLJ 2011 · Sindh High Court

This case concerns a petitioner, Hidayatullah, who was hired in 1996 on a "daily waged contract basis" by Telecom Foundation, a project linked to Pakistan Telecommunication Company Ltd. (PTCL). His appointment letter did not specify any fixed contract period, though it referred to separate terms and conditions supposedly agreed and signed by him. His employment was terminated shortly after, in December 1996. Many years later, after the government passed the Sacked Employees (Re-instatement) Act, 2010 to restore jobs to certain workers removed during earlier political periods, he filed a petition seeking reinstatement and back benefits under this law.

PTCL argued the case wasn't valid in court because PTCL's rules aren't government-backed (statutory), and that the petitioner had waited too long (delay, or "laches") to file his claim. The Sindh High Court rejected both objections: since the petitioner was asserting rights created by the 2010 Act itself—not just internal company rules—the petition was allowed, and since this right only came into existence in 2009-2010, there was no unreasonable delay.

On the merits, since PTCL could not produce any document proving a fixed contract term, and the petitioner denied signing one, the court held he qualified for reinstatement under Section 4(a) of the Act. The court ordered his reinstatement within two weeks, along with the benefits the law provides. This case clarifies how courts apply the Sacked Employees Act to contract workers lacking clear contract terms.

پی ٹی سی ایل نے موقف اختیار کیا کہ یہ مقدمہ عدالت میں نہیں چل سکتا کیونکہ پی ٹی سی ایل کے قواعد و ضوابط سرکاری
