He was sentenced to life imprisonment plus fines under Pakistan's Offence of Zina (Enforcement of Hudood) Ordinance, 1979, with multiple sentences running concurrently. Two co-accused were acquitted at trial, and one died during proceedings.
Maryam Bibi had filed a private complaint alleging she was abducted at gunpoint from her home, drugged, and held captive for about a month, during which she was repeatedly sexually assaulted. She said the motive was a grudge over an electricity connection dispute between her father and the accused.
The Federal Shariat Court's judgment focuses on a key legal principle rather than just the facts of the assault: that under Section 367 of the Criminal Procedure Code, a trial court's written judgment must clearly state the specific points it had to decide, and must give reasons for its decisions on each point. The court emphasized that a proper judgment must show that the trial judge carefully examined the evidence, considered the arguments of both sides, and applied independent judicial reasoning before convicting someone—rather than simply announcing a verdict.
