Exemption against appearance of accused

PLJ 2011 · Lahore High Court (Rawalpindi Bench)

This case is about whether an accused person facing criminal trial can get permanent exemption from appearing in court after leaving Pakistan for a job abroad, without prior court permission.

Tasawar Rasheed was facing trial in two criminal cases before a magistrate in Chakwal. While the cases were pending, he left for employment in Dubai without obtaining the court's permission, and only then applied for exemption from personal appearance under Section 540-A of the Criminal Procedure Code. The trial court rejected his applications because he had gone abroad without permission, and the Additional Sessions Judge upheld this decision on revision. He then challenged these orders before the Lahore High Court.

The High Court dismissed his petitions. It held that an accused cannot simply file an application for exemption and treat it as automatically granted; he must wait for the court to actually approve it before leaving. Courts should not mechanically grant such exemptions, but must consider whether they would still be able to enforce the accused's personal attendance later if needed. The judgment emphasized that an accused released on bail cannot be allowed to act unilaterally in ways that make it impossible for courts to control his movements.

This case matters because it clarifies that the privilege of bail and exemption from appearance comes with responsibility, and courts must protect their authority to ensure accused persons remain accountable during trial, preserving public confidence in the justice system.
