Appellant court can modify charge in a criminal case
PLJ 2011 Cr.C. (Lahore) 941 · Lahore High Court
This case involved Mst. Kausar Bibi, who was convicted by a trial court for causing a fatal injury that led to the death of Muhammad Amin, her husband. She was sentenced to pay Diyat (compensation) to the victim's heirs and also received fourteen years of rigorous imprisonment under Section 308 of the Pakistan Penal Code. The prosecution's case relied on her own confession, recovery of the body and weapon from her house, and medical evidence showing death from a blunt-weapon head injury. She appealed her conviction and sentence to the Lahore High Court.
The High Court examined the evidence and found that while the exact circumstances didn't conclusively prove she committed murder as originally charged, the evidence did support that she was involved in concealing the body of the deceased, an offence under Section 201 of the Penal Code. Importantly, the trial court had never formally charged her with this specific offence. The High Court ruled that appellate courts have the power, under various provisions including Section 561-A and related Criminal Procedure Code sections, to convict and sentence a person for an offence even if it wasn't separately charged at trial, as long as the evidence supports it and no injustice results. The court modified her conviction to Section 201 PPC and reduced her sentence to time already served.
This case matters because it clarifies that appellate courts can amend or add charges based on trial evidence, and that minor procedural gaps like non-framing of a charge don't automatically invalidate a conviction.
