This case involved a dispute over whether a woman, Parveen Naz, was validly married to a man named Ch. Maqbool Ahmad. Parveen Naz filed a suit seeking a declaration that no marriage existed between her and Maqbool Ahmad (called a suit for jactitation of marriage), claiming she had never married him and that the nikahnama presented was fake. She said she had earlier divorced her first husband and had since married another man, Imran Jadoon, of her own free will. Maqbool Ahmad denied this, insisting they had married in Karachi in 2003, lived together, and that she later left him without a divorce and remarried unlawfully. He filed his own suit seeking restitution of conjugal rights, meaning he wanted the court to order her to return to the marriage.
The Family Court in Muzaffarabad had dismissed the wife's suit for lack of proof and ruled in favor of the husband, ordering restitution of conjugal rights. She appealed this decision to the Azad Jammu & Kashmir High Court.
The High Court examined the evidence from both sides, including nikahnamas, witness testimony, and related court documents, and upheld the Family Court's decision. It held that even though the original nikahnama or its attesting witnesses were not produced, this did not weaken the husband's case given the overall evidence. اس مقدمے کا تعلق اس تنازعے سے ہے کہ آیا پروین ناز نامی خاتون کی شادی چوہدری مقبول احمد نامی شخص سے قانونی طور پر منعقد ہوئی تھی یا نہیں۔ پروین ناز نے عدالت میں یہ استدعا کرتے ہوئے دعویٰ دائر کیا کہ اس کے اور مقبول احمد کے درمیان کوئی نکاح موجود نہیں (جسے قانونی اصطلاح میں تشہیر نکاح کا دعویٰ کہا جاتا ہے)۔ اس کا موقف تھا کہ اس نے کبھی مقبول احمد سے نکاح نہیں کیا اور پیش کیا جانے والا نکاح نامہ جعلی ہے۔ اس کا کہنا تھا کہ وہ پہلے اپنے پہلے شوہر سے طلاق لے چکی تھی اور اس کے بعد اپنی مرضی سے عمران جدون نامی شخص سے نکاح کر چکی ہے۔ مقبول احمد نے اس موقف کی تردید کرتے ہوئے اصرار کیا کہ دونوں کا نکاح سن دو ہزار تین میں کراچی میں ہوا تھا، وہ میاں بیوی کی طرح ساتھ رہے، اور بعد ازاں وہ بغیر طلاق کے اسے چھوڑ کر چلی گئی اور غیر قانونی طور پر دوسری شادی کر لی۔ اس نے خود بھی عدالت میں بحالی حقوقِ زوجیت کا دعویٰ دائر کیا،
