Nikah registrar is a public officer

PLJ 2010 SC 891 · Peshawar High Court

This case arose from a marriage dispute. A wife filed suits in the Family Court seeking possession of half a house, dowry articles, gold ornaments, and maintenance from her husband. When the husband failed to appear despite being served notice (his lawyer initially appeared then stopped attending), the Family Court passed ex-parte decrees against him based on the wife's evidence. The husband later sought to have these decrees set aside, claiming he was never properly served, but his applications were dismissed as both time-barred and lacking merit. His subsequent appeals and constitutional petitions to the High Court were also dismissed, leading him to approach the Supreme Court.

The Supreme Court upheld the concurrent decisions of all lower courts. It clarified several important legal points: Family Courts can regulate their own procedures flexibly, are not strictly bound by the Civil Procedure Code but may apply its principles, and a Family Court has jurisdiction wherever the wife resides. Crucially, the Court held that the Nikahnama (marriage contract) is a public document carrying a legal presumption of authenticity, since it is verified by the Nikah Registrar, who qualifies as a public officer. Without evidence rebutting this presumption, the document stands as valid proof.

The judgment matters because it reinforces the evidentiary weight of Nikahnamas in family disputes and confirms that constitutional petitions cannot be used to re-examine factual findings already settled by lower courts.
