Judgment against proclamation of emergency on 3rd November
PLJ 2010 SC 1 · Islamabad High Court
This case was decided by the Supreme Court of Pakistan (Chief Justice Iftikhar Muhammad Chaudhry and thirteen other judges) in response to petitions filed by the Sindh High Court Bar Association and others challenging the Proclamation of Emergency imposed by General Pervez Musharraf on 3 November 2007.
On that date, Musharraf, then Chief of Army Staff, had suspended the Constitution, issued a Provisional Constitution Order, dismissed judges who refused to take a new oath under his Oath of Office Order, and made other sweeping changes affecting the judiciary, including altering judges' pensions and court structures. These actions were preceded by a letter from the Prime Minister to the President describing concerns about terrorism, militancy and alleged judicial interference with executive functions.
The Court held that this letter did not constitute constitutional advice under Article 48, was not addressed to the Army Chief, and gave no authority for imposing emergency rule or removing judges. It found that neither the President nor the Army Chief had any constitutional power to proclaim emergency, suspend the Constitution, or dismiss judges in this manner. Doing so violated constitutional protections for judicial independence and tenure under Articles 2A and 209.
The judgment matters because it declared the 2007 emergency and all related actions unconstitutional, reaffirming that no individual, however powerful, can override the Constitution or judiciary without lawful authority.
