Right of Daughter usurped in mutation challenged

PLJ 2010 · Lahore High Court

This case was about a woman, Mst. Zainab, who was denied her rightful share of inheritance from her father, Muhammad Ramzan. When her father died, a mutation (an official land revenue record change) was sanctioned in 1918 giving the entire property only to her brother, Allah Wasaya, leaving her out entirely. Her brother later gifted parts of this land to his own sons. Zainab, who was a pardah nashin (secluded) woman unfamiliar with legal and property matters, eventually sued through her son acting as her attorney, seeking a declaration that she was entitled to her Islamic (sharai) share of the inheritance. The defendants argued her claim was time-barred and that a local custom called pagwanda justified excluding daughters from inheritance.

The Lahore High Court ruled in Zainab's favor. It found no evidence proving the custom of pagwanda actually existed in that area, so it could not be used to deny her inheritance rights. The court also held that a mutation is not itself a document of title, inheritance automatically vests in heirs the moment someone dies, and such vesting does not depend on revenue authorities' actions. Since the original mutation was obtained through fraud and concealment, it was void from the start, meaning no limitation period could block her claim. The court ordered a fresh mutation be sanctioned giving Zainab her proper Islamic share. This case matters because it reinforces that daughters cannot be deprived of their lawful inheritance through fraudulent or unproven customary claims, and that technical limitation rules should not
